Welcome to the WP Care Plans website (the Website), which is operated by SevenDev A.B.N.63529916332 trading as SevenDev (we, us, our, or SevenDev).
Below are the Terms of Service regarding our subscription-based monthly services which include but are not limited to, WordPress maintenance, WooCommerce maintenance, SEO, and email marketing. We reserve the right to amend the Terms of Service at any time. Although we may notify you of any amendment, revision, or modification, it is your responsibility to periodically review the Terms of Service. You agree to be bound by such changes, modifications, or revisions as made by us from time to time.
You are engaging SevenDev, as an independent contractor to perform work as described in the package(s) or service(s) you have purchased. In the event access to your website is necessary, you hereby authorise SevenDev access and “write permissions” to all directories and files of your account with any other third-party hosting provider, as well as permission to install any necessary WordPress plugins for maintenance and security.
By purchasing one of the maintenance services provided by SevenDev, you agree to follow and abide by the Maintenance Plan Scope. A copy of this scope can be found at https://wpcareplans.au/plans/maintenance-scope/
Each of the maintenance services provided by SevenDev comes with a designated amount of support hours which can be used in accordance with the Maintenance Plan Scope. Once a client has reached the limit of their monthly support hours, alterations on their website will stop until the next billing cycle. The client is able to request additional work to be completed outside of the support hours, however, this will be billed at $85 per hour. There is a one-hour minimum.
Support hours cannot be banked and expire at the end of each billing period.
Support hours are to be used only on the website the maintenance plan has been purchased for unless otherwise specified by SevenDev.
SevenDev does not assume any responsibility or liability for the content of the websites it manages, maintains and/or hosts. If you provide any text, images or other digital media to us, it is your responsibility to ensure those assets do not breach copyright or other intellectual property laws.
When digital assets are created by SevenDev for use on your website or other third-party platforms, we will transfer the copyright of those assets solely to you.
Website Ownership: As a client of SevenDev, you will retain full ownership of your website. We are here to support and maintain your website, but the intellectual property and content of your site belong exclusively to you.
Assets Created During Maintenance: During the term of your maintenance plan, any custom assets created for your website, such as graphics, images, or code, can be used on your site indefinitely. However, these assets cannot be sold on digital marketplaces or redistributed without explicit written consent from SevenDev.
Premium Plugins with SevenDev License: If we install premium plugins on your website that are licensed under SevenDev or any similar license, you are not permitted to sell, sublicense, or redistribute these plugins in any form. These licenses are subject to the terms and conditions provided by the respective plugin developers, and any violations may result in the termination of our services.
All prices appearing on this site are subject to change without notice. Once a client of SevenDev, you authorise SevenDev to charge the payment method you submitted for all the invoices generated for the services rendered by SevenDev.
In the event that price changes affect your purchased services, you will be notified prior to the pricing adjustments.
In order to cancel your recurring payment or change payment method, simply contact SevenDev prior to your payment’s due date.
Cancellation of any monthly recurring service can occur at any time after your first 1 month (30 days) of service.
No Refunds are available after your purchased package or service has been started unless otherwise specified in writing and authorised by SevenDev.
SevenDev reserves the right to refuse service to any individual, website, or blogs that contain offensive, obscene, hateful, malicious content or any other reason.
With a WordPress-based website, clients are able to independently edit or update their web pages after completion of work on the site. If anyone other than SevenDev or its subcontractors attempts to update the website and damages the design or impairs the ability for the web pages to display or function properly, the time to repair the web pages will be deducted from the monthly support hours allocated. If additional time is required to correct any issues, work will be carried out at the hourly rate of $85 per hour. There is a one-hour minimum.
Although there are limitations to the guarantees we can provide, your satisfaction is very important to us. Please read and understand our limits of liability before ordering services.
SevenDev does not guarantee, represent, or warrant that the functions contained in these webpages or the Internet website will meet the client’s requirements or that the operation of the webpages will be uninterrupted or error-free.
You expressly agree that your use of, or inability to use, the functions contained in these webpages or the Internet website is at your sole risk. The functions of the webpages and the Internet website created for you are provided “as is” and “as available” for your use, without warranties of any kind.
To the extent not prohibited by law, in no event will SevenDev be liable to the client or any third party for any damages, including, but not limited to, any lost profits, lost savings, loss of data, business interruption, or incidental, consequential or special damages arising out of the operation of or inability to operate these webpages or website, however caused, even if SevenDev has been advised of the possibility of such damages.
SevenDev does not represent, guarantee or warrant that the functions contained in these webpages or Internet website will be free from loss, corruption, attack, viruses, interference, hacking, or other security intrusions, and SevenDev disclaims any liability relating thereto.
This Work Statement Agreement is governed by the laws of Queensland, Australia without giving effect to its conflict of laws provision. You expressly agree that exclusive jurisdiction for any claim or dispute with SevenDev or relating in any way to your use of the created webpages or Internet website resides in the courts of Queensland.
Please note that by submitting your payment, you are agreeing to all of our terms of service as they are written here. SevenDev reserves the right to change or update these terms at any time without prior notice. The user of this site agrees to the terms of this agreement on behalf of their organisation or business. This Agreement constitutes the entire understanding of the parties. Any changes or modifications thereto must be in writing and signed by both parties.
